October Petition Alleges Work Related Injury
In late October, a petition was filed in the Nebraska Workers’ Compensation Court against Kimball County Sheriff’s Office and NIRMA II (Its Workers’ Compensation Self Insurance Pool).
The petition by sheriff’s deputy Marla Knigge alleged that an “injury was caused to the plaintiff by accident or occupational disease, occurred or manifested on or about June 1, 2022, in Kimball County, Nebraska, arising out of and in the course of the plaintiff’s employment by the defendant, Kimball County Sheriff’s Office, and for which injury the plaintiff is entitled to compensation from the defendant.”
The petition continues, stating that the “plaintiff was employed as a Kimball County deputy sheriff, and was receiving salary or wages, or other earning from the defendant of approximately $1,200 a week, or more.”
The petition then makes reference to the type of injury: “That the extent and character of the injury sustained was a mental injury and/or mental illness unaccompanied by physical injury. The employer had notice and knowledge of said accident and injury on or about June 1, 2022. That the accident and injury occurred in the following manner: Plaintiff’s employment and condition were extraordinary and unusual in comparison to the normal condition of the particular employment.”
The Kimball County Sheriff’s Office and NIRMA were required to answer the petition by Nov. 10.
An update has yet to be filed in the Nebraska Workers’ Compensation Court.
Kimball County Attorney Dave Wilson said he was unable to comment on the action.
